Thriftful Terms of Service (Clients)

Welcome to Thriftful

These Terms of Service ("Terms") govern your use of the Thriftful platform and services. By creating an account, browsing bundles, requesting styling services, or using any Thriftful features, you agree to these Terms and our [Privacy Policy].

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM.


1. Acceptance of Terms

1.1 Agreement to Terms

By:

  • Creating a Thriftful account
  • Browsing stylists or bundles
  • Requesting a bundle
  • Completing your Style Story profile
  • Using any features of the platform (web or mobile app)

You acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1.2 Eligibility

To use Thriftful, you must:

  • Be at least 18 years of age (or 13-17 with parent/guardian consent)
  • Have the legal capacity to enter into binding contracts
  • Provide accurate account information
  • Not be prohibited from using the platform under applicable law

1.3 Account Registration

You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Not share your account with others
  • Notify us immediately of any unauthorized use

You are responsible for all activity that occurs under your account.


2. The Thriftful Platform

2.1 Platform Description

Thriftful is a marketplace that connects clients with personal stylists who curate custom thrifted and vintage clothing bundles. Our platform enables:

For Clients:

  • Browse stylists and their styling bundles
  • Complete a detailed Style Story profile (measurements, preferences, fashion goals)
  • Request custom bundles from stylists
  • Communicate with stylists through in-app messaging
  • Receive curated thrifted and vintage clothing tailored to your style and fit

For Stylists:

  • Create and publish styling bundle offerings
  • Receive and fulfill client requests
  • Access detailed client profile information to curate the perfect bundle
  • Manage orders and communicate with clients

2.2 Marketplace Model

Thriftful is a platform that facilitates transactions between clients and independent stylists. We:

  • Provide the technology and infrastructure
  • Process payments securely
  • Facilitate communication
  • Provide customer support

We do not:

  • Employ the stylists (they are independent contractors)
  • Source, curate, or ship the items in bundles
  • Guarantee outcomes, fit, or satisfaction
  • Control the specific items included in bundles

Each stylist is solely responsible for their bundle fulfillment, quality, and customer service.


3. Style Story Profile

3.1 Purpose

Your Style Story is a comprehensive profile that helps stylists curate bundles perfectly suited to your body, style, and preferences. It includes:

Personal Information:

  • Gender and measurement set preferences
  • Height and weight
  • Body measurements (bust/chest, waist, hips, inseam)

Size Information:

  • Size ranges for shirts, pants, dresses/jackets, and shoes
  • You may select up to 3 consecutive sizes per category (e.g., "S, M, L" or "30, 32, 34")
  • This accounts for the inconsistent sizing of thrifted and vintage clothing

Style Preferences:

  • Style keywords (e.g., "vintage," "grunge," "minimalist")
  • Aesthetic keywords (e.g., "dark academia," "cottagecore")
  • Color preferences (e.g., "neutrals," "earth tones," "pastels")
  • Item keywords (e.g., "dresses," "outerwear," "accessories")
  • Fit preferences (fitted, relaxed, oversized)
  • Fashion goals (e.g., "build confidence," "sustainable wardrobe")

3.2 Profile Completion

You are not required to complete your Style Story to browse the platform, but:

  • You must complete your Style Story before requesting bundles
  • Incomplete profiles will prevent bundle requests from being submitted
  • Your profile data auto-fills bundle request forms for convenience

3.3 Data Sharing

Important: When you request a bundle from a stylist, your complete Style Story profile is shared with that stylist to enable them to curate items that fit and match your preferences.

By requesting a bundle, you consent to sharing your:

  • Measurements and sizing information
  • Style and aesthetic preferences
  • Fashion goals
  • Any additional information you provide in custom questions

Stylists may only use this data to fulfill your specific order. See our [Privacy Policy] for more information.

3.4 Profile Accuracy

You are responsible for:

  • Providing accurate measurements and size information
  • Updating your profile if your measurements or preferences change
  • Understanding that inaccurate information may result in poor fit or styling mismatches

We recommend re-measuring periodically and updating your Style Story as your style evolves.


4. Browsing & Discovering Stylists

4.1 Stylist Profiles

All approved stylists have public profiles that include:

  • Bio and background information
  • Portfolio/Lookbook showcasing their work
  • Style specialties and aesthetic keywords
  • Social media and website links
  • Bundles they offer

Stylist profiles are accessible at unique URLs (e.g., thriftful.app/s/stylistname) and can be shared.

4.2 Bundles

Bundles are styled offerings created by stylists, typically including:

  • Bundle title and description
  • Pricing
  • Estimated timeline (e.g., "1-2 weeks," "ASAP")
  • Style, aesthetic, color, and item keywords
  • Cover image and additional photos
  • Optional custom questions for requesters

4.3 Stylist Selection

Thriftful does not endorse or guarantee any stylist's work. You are responsible for:

  • Reviewing stylist portfolios and bundle descriptions
  • Evaluating if a stylist's aesthetic matches your preferences
  • Asking questions before requesting a bundle
  • Making informed decisions about which bundles to request

5. Bundle Requests & Orders

5.1 Requesting a Bundle

To request a bundle:

  1. Browse stylists or bundles
  2. Complete your Style Story if not already done
  3. Select a bundle and click "Request Bundle"
  4. Review auto-filled profile data
  5. Add any optional information (Pinterest board, custom question responses)
  6. Submit your request

Submitting a request does not guarantee acceptance. Stylists may accept or decline requests at their discretion.

5.2 Stylist Acceptance

After you submit a request:

  • The stylist reviews your profile and request details
  • They may message you with questions or clarifications
  • They will accept or decline your request
  • If accepted, payment is processed and the stylist begins sourcing

You will receive notifications at each stage of the process.

5.3 Payment Authorization

When a stylist accepts your bundle request:

  • Your payment method is charged the bundle price
  • Payment is held securely by Thriftful
  • Funds are released to the stylist upon successful delivery and completion

By submitting a bundle request, you authorize us to charge your payment method if the stylist accepts.

5.4 Stylist Fulfillment

Once your request is accepted, the stylist is responsible for:

  • Sourcing items that match your measurements, preferences, and style
  • Curating a cohesive bundle aligned with your fashion goals
  • Packaging and shipping the bundle to your provided address
  • Providing tracking information

Stylists commit to the timeline specified in their bundle description, but delays may occur. Check the order status in your account for updates.

5.5 Order Cancellation by Client

You may cancel a bundle request:

  • Before stylist acceptance: Free cancellation, no charge
  • After stylist acceptance, before shipping: Contact the stylist and Thriftful support; refunds are at the stylist's discretion and depend on sourcing status
  • After shipping: Cancellation is not available; see Returns (Section 8)

6. Pricing & Payments

6.1 Bundle Pricing

  • Bundle prices are set by individual stylists
  • Prices displayed include the cost of sourced items, styling service, and stylist's time
  • All prices are in USD

6.2 Payment Methods

We accept:

  • Credit and debit cards (Visa, Mastercard, American Express, Discover)
  • Other payment methods supported by Stripe

6.3 Payment Processing

  • Payments are processed securely through Stripe
  • You are charged when a stylist accepts your bundle request
  • Funds are held by Thriftful and released to the stylist upon successful delivery

6.4 Shipping Costs

  • Shipping costs are included in the bundle price set by the stylist (unless otherwise stated)
  • Stylists are responsible for packaging and shipping arrangements
  • You will receive tracking information once your bundle ships

6.5 Taxes

  • You are responsible for any applicable sales tax, VAT, or other taxes based on your location
  • Taxes (if applicable) will be calculated and added at checkout

6.6 No Hidden Fees

Thriftful does not charge clients additional platform fees or service charges beyond the bundle price and applicable taxes.


7. Shipping & Delivery

7.1 Shipping Responsibility

Stylists are solely responsible for:

  • Selecting shipping carriers and methods
  • Packaging items securely
  • Covering shipping costs (included in bundle price)
  • Providing tracking information

7.2 Delivery Address

You must:

  • Provide an accurate, complete shipping address
  • Update your address if it changes before shipping
  • Be available to receive packages or arrange for secure delivery

We are not responsible for delivery failures due to incorrect addresses.

7.3 Delivery Timeframes

  • Delivery times vary based on the stylist's location, shipping method, and carrier
  • Estimated timelines are provided by stylists but are not guaranteed
  • Contact the stylist or Thriftful support if your bundle is significantly delayed

7.4 Lost or Damaged Shipments

If your bundle is lost or damaged in transit:

  • Contact Thriftful support immediately at support@thriftful.app
  • Provide tracking information and details
  • We will work with you and the stylist to resolve the issue (refund, replacement, or insurance claim)

8. Returns, Refunds & Disputes

8.1 Return Eligibility

You may request a return if:

  • Items do not match the stylist's description
  • Items have undisclosed damage, defects, or stains
  • Sizing is significantly incorrect based on your provided measurements

8.2 Return Process

To initiate a return:

  1. Contact the stylist through Thriftful messaging within 7 days of delivery
  2. Provide photos and a detailed explanation of the issue
  3. Work with the stylist to resolve the issue
  4. If unresolved, escalate to Thriftful support at support@thriftful.app

8.3 Return Shipping

  • If the return is due to stylist error (misdescription, damage, etc.), the stylist should cover return shipping
  • If the return is due to fit issues despite accurate measurements, you may be responsible for return shipping
  • Thriftful will mediate disputes about return responsibility

8.4 Refunds

Refunds are issued if:

  • The stylist fails to fulfill your order
  • Items do not match the description
  • Items have undisclosed defects
  • Thriftful determines a refund is warranted after dispute resolution

Refunds are processed to your original payment method within 5-10 business days.

8.5 Fit & Style Preference

Important: Because bundles are custom-curated based on your Style Story profile:

  • You are not guaranteed a refund for fit issues if you provided inaccurate measurements
  • You are not guaranteed a refund based on personal style preference or "change of mind"
  • We encourage you to review stylist portfolios carefully and ask questions before requesting

Vintage and thrifted sizing is inherently unpredictable, which is why we collect size ranges and detailed measurements. Stylists use their best judgment, but fit cannot be guaranteed.

8.6 Dispute Resolution

If you have a dispute with a stylist:

  1. Attempt to resolve directly through Thriftful messaging
  2. If unresolved within 48 hours, contact Thriftful support at support@thriftful.app
  3. Provide all relevant information, photos, and communication history
  4. Thriftful will review and mediate the dispute in good faith
  5. Our decision regarding refunds or resolution is final

9. Communication & Conduct

9.1 In-App Messaging

  • All communication with stylists should occur through the Thriftful messaging system
  • This ensures transparency, safety, and record-keeping
  • Do not share personal contact information or arrange off-platform transactions

9.2 Professional Conduct

You agree to:

  • Treat stylists with respect and courtesy
  • Provide honest, accurate information
  • Communicate clearly about your needs and expectations
  • Respond to stylist messages in a timely manner

9.3 Prohibited Conduct

You may not:

  • Harass, abuse, threaten, or discriminate against stylists or other users
  • Use the platform for illegal or fraudulent purposes
  • Attempt to circumvent platform fees or arrange off-platform payments
  • Impersonate others or create multiple accounts to abuse the system
  • Post or share inappropriate, offensive, or harmful content
  • Attempt to hack, disrupt, or damage the platform

Violations may result in account suspension or termination.


10. Intellectual Property & Content

10.1 Your Content

Any content you upload (profile photos, Pinterest boards, messages) remains your property. By uploading, you grant Thriftful:

  • A license to use, display, and store your content as necessary to provide the service
  • The right to include your content in platform features and communications

10.2 Thriftful Content

All platform features, designs, logos, trademarks, and technology are owned by Thriftful. You may not:

  • Copy, reproduce, or modify our platform
  • Use Thriftful branding or intellectual property without permission
  • Reverse engineer or scrape data from the platform

10.3 Stylist Content

Stylists retain ownership of their portfolio images and bundle content. You may not:

  • Copy, reproduce, or use stylist images without permission
  • Claim stylist work as your own

11. Disclaimers & Limitations

11.1 Nature of Thrifted & Vintage Clothing

By using Thriftful, you acknowledge and accept that:

  • Thrifted and vintage clothing is pre-owned and may show signs of wear appropriate for its age
  • Sizing in vintage clothing is inconsistent and unpredictable compared to modern sizing standards
  • Items may have minor imperfections, patina, or vintage characteristics
  • Fit cannot be guaranteed despite detailed measurements (due to the nature of secondhand items)
  • Color and condition may vary slightly from photos
  • Items are not returns or exchanges unless there is a material misdescription or defect

11.2 Stylist Independence

  • Stylists are independent contractors, not employees of Thriftful
  • Thriftful does not control stylist actions, quality, or fulfillment
  • We do not guarantee stylist performance or outcomes
  • Each stylist is solely responsible for their bundles and customer service

11.3 Platform Availability

We strive to maintain platform availability but do not guarantee:

  • Uninterrupted or error-free service
  • Defects will be corrected promptly
  • The platform is free from viruses or security vulnerabilities

11.4 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.5 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Thriftful is not liable for:

  • Stylist actions, errors, delays, or failures
  • Quality, fit, or condition of items in bundles
  • Lost profits, revenue, or business opportunities
  • Indirect, incidental, special, or consequential damages
  • Shipping delays, lost packages, or carrier issues
  • Disputes with stylists

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE BUNDLE THAT GAVE RISE TO THE CLAIM.


12. Account Termination

12.1 Termination by You

You may close your account at any time by:

Upon closure:

  • Pending orders must be completed or cancelled
  • Refunds (if any) will be processed
  • Your account data will be handled according to our Privacy Policy

12.2 Termination by Thriftful

We may suspend or terminate your account if:

  • You violate these Terms or our policies
  • You engage in fraudulent, abusive, or illegal behavior
  • We are required to do so by law
  • Your account has been inactive for an extended period

We may also terminate your account with 30 days' notice for any reason.

12.3 Effect of Termination

Upon termination:

  • Your access to the platform is revoked
  • Pending orders must be completed or refunded
  • Provisions that by their nature should survive (liability, disputes, intellectual property) will continue

13. General Provisions

13.1 Changes to Terms

We may update these Terms at any time. Changes will be:

  • Posted with a new "Last Updated" date
  • Notified via email or in-app notification
  • Effective 30 days after posting (or immediately for legal/security changes)

Continued use of the platform after changes constitutes acceptance.

13.2 Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

13.3 Dispute Resolution

Informal Resolution: Before filing a claim, contact us at hello@thriftful.app to attempt informal resolution.

Arbitration: Disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules, conducted in San Francisco, California. You waive the right to participate in class actions or jury trials.

Exceptions: Either party may seek injunctive relief in court for intellectual property disputes.

13.4 Severability

If any provision is found invalid, the remaining provisions remain in effect.

13.5 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

13.6 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Thriftful.

13.7 Assignment

You may not assign this Agreement. We may assign our rights without restriction.

13.8 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control.

BY CREATING AN ACCOUNT OR USING THE THRIFTFUL PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

You further acknowledge that:

  • Thriftful is a marketplace platform connecting clients with independent stylists
  • Stylists are solely responsible for bundle fulfillment and quality
  • Thrifted and vintage clothing is pre-owned and has inherent unpredictability
  • You must provide accurate measurements and profile information
  • Your Style Story data will be shared with stylists when you request bundles
  • Returns and refunds are subject to specific conditions
  • You agree to the dispute resolution and arbitration provisions
